LEGAL GUARANTEE OF CONFORMITY

1. Subject

All products purchased on coolshopofficial.com by a consumer are covered by the Legal Guarantee of Conformity provided for by the Consumer Code.

The guarantee protects the consumer in the event of a product non-conformity defect, that is, when the goods do not correspond to what is provided for by the sales contract or have characteristics, qualities, or functionalities that do not conform to those provided for by law and the contract.

The legal guarantee is distinct from the right of withdrawal and does not modify its conditions.

2. Duration of the guarantee

For new products, the Legal Guarantee of Conformity has a duration of 2 years from the date of delivery of the product.

The guarantee covers non-conformity defects existing at the time of delivery that manifest during the period provided for by law.

The consumer's action to assert defects not deliberately concealed by the seller expires, unless otherwise provided by law, within 26 months from the delivery of the product.

3. When a product is conforming

A product is conforming to the contract when, among other things:

• it corresponds to the description, type, quantity, and characteristics provided for by the contract;

• it is suitable for the uses for which goods of the same type are normally used;

• it has the quality and characteristics normally expected for goods of the same type;

• it corresponds, when provided for, to the sample or model presented to the consumer;

• it is supplied with the accessories and instructions provided for by the contract or applicable regulations.

4. What the Legal Guarantee covers

The Legal Guarantee covers original non-conformity defects, that is, those attributable to a condition of the product existing at the time of delivery.

For example, manufacturing defects, characteristics different from those declared, or malfunctions not attributable to the normal use of the product may fall under the guarantee.

The guarantee does not, however, cover defects or damage resulting, for example, from:

• normal wear and tear of the product;

• use not in accordance with the characteristics or instructions of the product;

• improper or negligent use;

• accidental damage;

• unauthorized modifications or interventions carried out on the product;

• lack of or incorrect maintenance, when required.

The assessment of the existence of a non-conformity defect is carried out on the basis of the characteristics of the product, the nature of the defect, and the circumstances of the specific case.

5. Who the customer should contact

To exercise the Legal Guarantee, the consumer must contact:

as the seller of the product.

The consumer is not required to contact the manufacturer directly to exercise the Legal Guarantee against the seller.

6. How to request assistance

To report an alleged non-conformity defect, the customer must contact COOL SHOP at the following contact details:

In the request, it is advisable to indicate:

• order number;

• first and last name of the purchaser;

• product concerned;

• description of the defect found;

• any photographs or other elements useful to document the problem.

COOL SHOP may request the customer to provide the information necessary to carry out an initial assessment of the defect and establish the procedures for handling the request.

7. Proof of purchase

To exercise the Legal Guarantee, it is necessary to be able to prove the purchase and the delivery date of the product.

For this purpose, the order confirmation, invoice, receipt, or other suitable documentation may be used, for example.

The Ministry of Enterprises and Made in Italy indicates that the Legal Guarantee can also be asserted through other elements suitable to prove that the purchase has taken place.

8. Remedies provided by law

In the presence of a non-conformity defect, the consumer has the right, according to the conditions and hierarchy provided for by law, to the restoration of the conformity of the product by repair or replacement, free of charge.

When the primary remedies are not practicable in the cases provided for by the regulations, the consumer may be entitled to a proportional reduction of the price or the termination of the contract.

The applicable remedy is determined in compliance with the current regulations and the specific circumstances of the case.

9. Repair or replacement

The repair or replacement must be carried out at no cost to the consumer and according to the terms provided for by the applicable regulations.

If the product is returned to COOL SHOP to be inspected or to proceed with the repair or replacement, COOL SHOP will provide the customer with the necessary instructions for the return.

10. Defects manifesting within the first year

For non-conformity defects that manifest within one year from delivery, the law provides, except for the exceptions established by the regulations, a presumption that the defect already existed at the time of delivery.

After this period, it is up to the consumer to provide proof that the defect was already present at the time of delivery, in the cases and according to the procedures provided for by law.

11. Legal Guarantee and right of withdrawal

The Legal Guarantee of Conformity and the right of withdrawal are two distinct rights.

The right of withdrawal allows the consumer to return a product within the terms and conditions provided for by the relevant regulations, even in the absence of a defect.

The Legal Guarantee, on the other hand, concerns exclusively cases of product non-conformity defect.

12. Products purchased on promotion or during sales

The sale of a product at a discounted price, on promotion, or during a sale period does not eliminate or limit the Legal Guarantee of Conformity.

The guarantee continues to apply according to what is provided for by law.

Any defects specifically declared to the consumer before purchase and accepted by the consumer are assessed according to the applicable regulations.

13. Personalized products or products made to order

The eventual personalized nature or production on the customer's specific request does not exclude, in itself, the Legal Guarantee of Conformity.

However, the provisions relating to the right of withdrawal and any exclusions provided for by law for products made according to customer specifications remain in force.

14. Sales to professionals

This page governs the Legal Guarantee provided for by the regulations protecting consumers, that is, natural persons who purchase for purposes unrelated to any entrepreneurial, commercial, artisanal, or professional activity they may carry out.

For purchases made by subjects operating within the scope of their professional or entrepreneurial activity, the various provisions provided for by the applicable regulations apply.

15. Non-waivable consumer rights

The rights recognized to the consumer by the regulations on the Legal Guarantee of Conformity cannot be excluded or limited by contractual agreements to their detriment.

This policy does not limit in any way the rights recognized to the consumer by the applicable Italian and European regulations.
